Descriptive Notes: The International Military Tribunal (IMT) concluded on Oct. 1, 1946. On Oct. 11th, the Allied Control Council confirmed the sentences and on Oct. 16th it executed the death sentences. On Oct. 17, 1946, Justice Robert H. Jackson (1892-1954) resigned his position as Chief of Counsel of the Office, U.S. Chief of Council for Prosecution of Axis Criminality (OCCPAC). On October 24, 1946, General Joseph T. McNarney (1893-1972) appointed Brig. Gen. Telford Taylor Chief of Counsel for the Office, Chief of Counsel for War Crimes (OCCWC). OCCWC, which replaced (OCCPAC), was established as a division of the Office of the Military Governor - United States (OMGUS). The mission of the OCCWC was to prepare the charges against the indicted defendants and to present the prosecution's case before the tribunals. During its existence from Oct. 24, 1946 to June 20, 1949, the organization of the OCCWC had to remain flexible as its case work moved from the preparatory to the trial stages. Despite this elasticity, the OCCWC’s basic structure remained relatively unchanged throughout its existence. This structure was divided into two main segments, which were further delineated into several divisions. The "professional" segment of the OCCWC comprised the legal and evidence divisions. Throughout the trials, the mission of the professional segment remained the preparation and presentation of a particular case or type of case. The other OCCWC segment included such “administrative” or “service” divisions as Administrative, Reproduction, Signal, and Language branches. The task of these "service" divisions was to provide full administrative support during the trials. The Signal Division, for example, installed and maintained the simultaneous interpreting system in the Nuremberg courtrooms. (See, Final Report at pg. 42.) These preceding administrative divisions, in turn, were aligned under and reported to the Executive Officer. (See, Final Report at 39 and 41.) Descriptive Notes: The Nuremberg Military Tribunals (NMT) or "subsequent trials" consisted of 12 major trials and involved 185 defendants. These trials were held at Nuremberg by OMGUS between December 1946 and April 1949. (See, Laqueur, Walter and Judith Tydor Baumel, eds., "War Crimes," The Holocaust Encyclopedia (2001): 676.) See also, Final Report at 90-93.)

The prosecution utilized a four-pronged analysis in selecting individuals to be tried before the NMT. First, the NMT had to make general decisions about what individuals should be accused through the collection and analysis of oral and documentary evidence. (See, Final Report, at 74-75.) Second, the NMT had to become familiar with the organization and functions of the Nazi Reich through the compiling of analytical studies. These reports were utilized to draw conclusions about the locus of criminal responsibility within each bureaucracy. Third, the NMT had to ascertain the location of important war crime suspects through the Apprehension and Locator Branch. For example, a large number of suspected criminals were not located and, therefore, not available for prosecution until a year or more after the end of the war. (See, Final Report, at 74-75) Fourth, the NMT had to contend with the affect of such overall policy and administrative factors as time, staff and money. Although these trials were deemed important, they could not grow out of proportion to other occupation programs and activities. (See, Final Report, at 76. Under these four limitations, the NMT decided to group the defendants according to their primary sphere of activity. This decision greatly reduced the factual scope and enhanced the expediency of the trials. (See, Final Report, at 76.) These primary spheres of activity included the following subject areas: medical, legal, ethnological, economic, military, and political. The 12 trials, in turn, were arranged under these subjects.

Descriptive Notes: This subseries contains archival materials related primarily to the various Nuremberg publication projects engaged in by Prof. Taylor at the conclusion of the Nuremberg Military Tribunals. Prof. Taylor believed firmly that the United States Government had made a heavy moral investment in the trials and, therefore, the records of the proceedings must made available to the public for three main reasons. First, the reputation of the Nuremberg judical process must be protected and cannot be allowed to be diminished by ill-informed discussion created by a lack of access to the truth. Second, the Nuremberg records must aid in the development of a workable and enlightened system of international law. Third, Nuremberg proceedings must be made available in order to promote the reestablishment of democracy in Germany. (See, Final Report, at 100-101.) The remaining files relate to assisting his staff in obtaining post-Nuremberg employment and tracking the administration of the Landsberg Prison.
